Knowing What’s in Your Excavation Contract
We understand that most people don’t enjoy reading contracts. And, we also want to provide you with a positive and transparent experience throughout every phase of your project. This is why we have compiled a simple list below of notes to consider when signing our Excavation Services Contract via SignNow. Consider this list to be an easy guide for navigating things you should know within our contract. As with your entire project, you may reach out to us at any time with questions or concerns.

Our Colorado registered corporation name is High Performance Homes LLC. You may receive invoices from us under this name.
Please double-check to make sure we have your contact and job site information correctly written.
The Scope of the Project is based on the bid submitted to you by us and agreed upon by both parties.
We honor the cost of your project “sum”, based on the bid provided to you.
Time of commencement and completion are always tricky in our industry, as they are dependent on weather, resources available and potential scheduling and delivery changes. We typically know these dates within a 2-week time frame and we can usually work with your schedule if you have any specific requests or needs.
The bid that we agree upon is always referenced in your Contract.
We promise to complete the work we’ve agreed to do for you in a timely, efficient and professional manner and provide all the resources associated with the work, as outlined in the bid.
Sometimes we encounter unexpected challenges or issues along the way which may warrant a “Change Order”. While we try to avoid these as much as possible, we sometimes (though, not commonly) have to bill extra for these services. We do our best to inform all our customers in advance when there is a likelihood that this may occur.
We do our best to stay on schedule for all present and upcoming projects. If you would like additional work done after your contract has been signed that is not defined in our bid or necessary to the work scope of your contracted project, we may charge our normal rates at 150% for any last-minute Change Order requests.
We typically bill for projects in two (2) ways:
Weekly, on a time-and-materials basis, or
A $500 deposit toward your total cost to secure your project on our calendar, along with a 50% payment due just prior to mobilizing on your job site (or the cost of materials, whichever is greater).
Your total balance is due in full at the completion of our work and/or when any final inspections needed have been approved.
We are a licensed and insured business and we take pride in our professionalism and level of responsibly.
There are a bunch of things not immediately associated with our work that you are responsible for. Here are the most common ones to know about:
You or your General Contractor must receive permits and pay their associated costs for any of our work that requires one.
Fencing and gates that block access should be taken down, unless you have requested that we demolish any and which is included in your bid.
Any bedrock or other sub-surface material that we encounter and which must be removed is additionally billed at our hourly rate.
You or your engineer may decide to test your soil with a third party, since we do not include this service.
Any pavement obstructing or in the path of the work scope should be protected prior to our work, as we do not include re-paving in our services.
Any objects or possessions that obstruct or inhibit access should be removed prior to our arrival.
You are responsible for identifying and clearly marking all private utility lines in the work zone area, or the cost of repairs. We can provide this service for an additional fee.
We typically include reclamation of landscaping, such as seeding and mulching, in our services for an additional fee.
During winter and early spring months, the freeze-thaw action of soil in our region can cause problems with compaction and soil settling of an excavation project. We do our best to mitigate these problems, if they arise. However, any compaction, septic installation, or utility line repair projects during these months may lead to additional repair costs later down the road that are the responsibility of the customer.
During winter months, you may need to hire a snow removal company to clear your job site, since we do not include snow or ice removal in our services.
Our work can create dust, but we do our best to minimize any issues.
Our work is outside and, therefore, influence by the weather. Snow, heavy rain, high winds and thunderstorms can impact the timeline of your project. We do our best to work in allowable conditions. If your active project requires additional time or resources to prevent major loss of progress due to extreme weather conditions, you will be notified of this necessity and billed on a time-and-materials basis for the additional costs.
We do our best to predict any potential challenges that may come up prior to the commencement of your project and inform you of them beforehand. On the rare occasion an issue arises that was not foreseen, we will assist in overcoming the issue and bill it out on a time-and-materials basis.
You will be immediately notified if there are any significant changes to the Contract or Work Change Orders required. They will also be submitted to you in writing.
If there are ever any unresolved disputes regarding the Work or Contract, we support professional mediation within the district court system of Boulder County, Colorado.
*Though, not in the contract, we’ve included in our email – the one that provides you with this page link – a note about project updates. It is our practice to provide you with a weekly update every Friday for the life cycle of your active job site. If your project requires that any utility or septic use be down for a period of time, we will notify you of this expected timeframe prior to the shutoff.
